Terms of service are at the heart of how we connect, collaborate, and grow on HelaWorks. Everything in this document protects our community, supports fair work, and ensures clients and freelancers engage with confidence.
Acceptance of terms
By registering for or using the HelaWorks platform ("Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must immediately cease all use of our services.
- Applies to all registered clients, freelancers, and university student talent
- Continued platform use following policy updates constitutes binding consent
- You must be at least 16 years of age to register an account
Eligibility & verification
To ensure a trusted environment for Sri Lankan businesses and professionals, all members must meet baseline verification and legal eligibility requirements.
- You confirm you possess legal capacity to enter into binding contracts
- University student accounts require valid institutional verification
- Users must not be restricted or barred under Sri Lankan law
User accounts & security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your profile.
- Provide accurate, truthful, and complete registration information
- Account sharing or selling profile access to third parties is strictly prohibited
- Promptly notify HelaWorks Support of any unauthorized access
Platform rules & conduct
HelaWorks maintains high professional standards. Engaging in prohibited activities will result in immediate suspension and account closure.
- No off-platform transactions to circumvent platform fees or escrow
- No false advertising, misleading gig promises, or fake reviews
- No harassment, abusive language, malware distribution, or IP infringement
5. Payments, Fees & Escrow Guarantee
HelaWorks operates a strict escrow model to ensure financial safety for every client and freelancer. Funds are deposited before work begins and released only after explicit client approval.
Client Escrow Hold
Client payments are deposited into safe escrow and never sent directly to freelancers beforehand.
Milestone Approvals
Funds are released milestone by milestone or upon final sign-off by the client.
Refund Protections
Non-deliveries or disputes are governed strictly under our Refund Policy.
Intellectual property
Unless explicitly agreed upon in writing prior to order placement, full intellectual property rights transfer to the client upon full payment release.
- Freelancers deliver original work free of copyright or trademark encumbrance
- Freelancers retain rights to display completed work in portfolios unless NDA agreed
- HelaWorks brand assets and code remain exclusive property of HelaWorks LK
Dispute resolution SLA
When disagreements arise, HelaWorks provides neutral mediation to review project requirements, messages, and submitted deliverables.
- Parties must first attempt good-faith direct resolution via platform chat
- Unresolved disputes are escalated to HelaWorks Mediation within 3 days
- HelaWorks' final decision on escrow distribution is binding on both parties
Termination of service
HelaWorks reserves the right to suspend or close accounts that breach platform rules, engage in fraud, or compromise community safety.
- You may close your account at any time via Profile Settings
- Termination does not relieve parties of pending escrow or contract obligations
- Fraudulent accounts forfeit pending balances subject to legal review
Limitation of liability
HelaWorks is a freelance marketplace facilitator and is not a direct employer or party to individual freelancer contracts.
- Platform is provided on an "as-is" basis with high availability guarantees
- HelaWorks is not liable for indirect, incidental, or consequential damages
- Maximum aggregate liability is limited to fees collected in prior 12 months
Governing law & jurisdiction
These Terms of Service are governed exclusively by and construed in accordance with the Laws of Sri Lanka. Any legal action or proceeding arising out of these terms shall be brought exclusively in the competent courts of Sri Lanka.
